NOTICE OF FORECLOSURE SALE
TALLAPOOSA COUNTY
Default having been made in the payment of the indebtedness secured by that certain mortgage executed by James R Gunn and Deirdre Gunn, husband and wife, originally in favor of Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Fairway Independent Mortgage Corporation, its successors and assigns on March 22, 2022, said mortgage recorded in the Office of the Judge of Probate of Tallapoosa County, Alabama, at Book 2022, Page 362000; the undersigned TH MSR Holdings, LLC, as Mortgagee/Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash or certified funds, in front of the main entrance of the Courthouse at Tallapoosa County, Alabama, on October 20, 2026, during the legal hours of sale, all of its right, title, and interest in and to the following described real estate, situated in Tallapoosa County, Alabama, to-wit:

Commencing at a point that is 258 feet North 02° 10’ West from the North edge of Pavement of Semmes Street (as of November 5, 1941) from which North 87’50’ East 173 feet to a
comer, from which North 02° 10’ West 100 feet to a corner, from which South 87° 50’ West 173 feet to a comer on the East side of Houston Street (as of November 5, 1941); from which
South 02° 10’ East 100 feet to the starting point; being a part of Block G of the Alber & Byrne map of Alexander City, Alabama; and fronting 100 feet on the East side of Houston
Street; together with all appurtenances thereon situated and thereunto belonging.
This sale will be made subject to any right of the United States of America to redeem the hereinabove described property within 120 days from the sale date aforesaid, in order to satisfy certain outstanding federal tax liens.

THIS PROPERTY WILL BE SOLD WITHOUT WARRANTY OR RECOURSE, EXPRESSED OR IMPLIED AS TO TITLE, USE AND/OR ENJOYMENT AND WILL BE SOLD SUBJECT TO THE RIGHT OF REDEMPTION OF ALL PARTIES ENTITLED THERETO.

If sale is voided, Mortgagee/Transferee shall return the bid amount to the successful purchaser. The Mortgagee/Transferee and Aldridge Pite, LLP shall not be liable to the purchaser for any damages. If the sale is set aside for any reason, the purchaser at the sale shall be only entitled to a return of the bid amount.
