ORDINANCE NO. 527
AN ORDINANCE OF THE CITY OF DADEVILLE, ALABAMA, AMENDING THE CITY’S SALES TAX AND USE TAX RATES TO FOUR PERCENT (4.0%), EFFECTIVE OCTOBER 1, 2026
WHEREAS, the City Council of the City of Dadeville, Alabama, is authorized by the Constitution and laws of the State of Alabama to levy and collect municipal sales and use taxes; and
WHEREAS, the City Council finds that additional revenues are necessary to maintain and improve municipal services, public safety, infrastructure, parks, economic development, and other municipal functions; and
WHEREAS, the City Council has determined that increasing the City’s sales and use tax rates to four percent (4.0%) is in the best interest of the City and its citizens;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DADEVILLE, ALABAMA, AS FOLLOWS:
SECTION 1. PURPOSE.
The purpose of this Ordinance is to amend the City’s existing sales tax and use tax ordinances by establishing a municipal sales tax rate and municipal use tax rate of four percent (4.0%).
SECTION 2. SALES TAX RATE.
The municipal sales tax imposed by the City of Dadeville upon persons, firms, corporations, associations, and other entities engaged in businesses or activities subject to municipal sales taxation shall be levied at the rate of four percent (4.0%) of the gross proceeds of sales, receipts, or other taxable measure as provided by applicable law.
SECTION 3. USE TAX RATE.
The municipal use tax imposed by the City of Dadeville upon the storage, use, consumption, or distribution of tangible personal property within the City shall be levied at the rate of four percent (4.0%) of the sales price or other taxable measure as provided by applicable law.
SECTION 4. EFFECTIVE DATE.
The sales tax rate and use tax rate established by this Ordinance shall become effective on October 1, 2026, and shall apply to all taxable transactions occurring on or after that date.
SECTION 5. ADMINISTRATION AND COLLECTION.
The taxes imposed by this Ordinance shall be administered, collected, enforced, and remitted in accordance with applicable provisions of Alabama law, including any applicable provisions of the Alabama Code and any agreements between the City and the Alabama Department of Revenue or other authorized collecting agency.
SECTION 6. INCORPORATION OF EXISTING TAX ORDINANCES.
Except as specifically amended herein with respect to the tax rates, all provisions of the City’s existing sales tax and use tax ordinances shall remain in full force and effect.
SECTION 7. REPEAL OF CONFLICTING PROVISIONS.
All ordinances, resolutions, policies, or parts thereof in conflict with this Ordinance are hereby repealed to the extent of such conflict.
SECTION 8. SEVERABILITY.
If any section, subsection, sentence, clause, phrase, or provision of this Ordinance is held invalid or unconstitutional by a court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance.
SECTION 9. PUBLICATION.
This Ordinance shall be published and recorded as required by law.
