PUBLIC NOTICE

NOTICE OF MORTGAGE FORECLOSURE SALE

Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Bill R. Evans (hereinafter called “Mortgagor”) to Donna G. Currie (hereinafter called “Mortgagee”) on the 7th day of March, 2003, said mortgage being recorded in the office of the Judge of Probate of Tallapoosa County, Alabama, on Recorded Card Number 179527, and said default continuing, the Mortgagee has elected to declare the entire indebtedness secured by the said mortgage to be due and payable as provided in said mortgage, and notice is hereby given that pursuant to law and the power of sale contained in said mortgage, the undersigned will sell at public outcry, to the highest bidder for cash, at the front door of the Tallapoosa County Courthouse in Dadeville, Tallapoosa County, Alabama, during the legal hours of sale on the 22nd day of May, 2026, the following described real estate situated in the County of Tallapoosa, Alabama, to-wit:
Commencing at the NW corner of the SE ¼ of the NW ¼ of Section 1, T-22-N, R-21-E, Tallapoosa County, Alabama: thence run N 86 degrees 57’ 59” E, 215.305 to an iron pin set; thence run S 17 degrees 18’ 58” W 501.447 feet to a point in the center of Scott Road; thence run along the center of Scott Road chord bearing and distances as follows: N 48 degrees 53’ 09” W 73.717 feet; thence N 47 degrees 16’ 12” W 189.444 feet to a PK nail; thence run N 23 degrees 56’ 57” E 317.655 feet to the point of beginning. Said parcel being a part of and lying in the SE ¼ of the NW ¼ of Section 1, T-22-N, R-21-E, Tallapoosa County, Alabama, and contains 2.078 acres more or less, together with the hereditaments and appurtenances thereunto belonging. Said property will be sold on an “AS IS, WHERE IS” basis subject to all easements, encumbrances, and exceptions contained in the mortgage and those contained in the records of the Office of the Judge of Probate where the above-described property is situated, and to any Federal or State Tax liens, if any, and/or special assessments. This property will be sold without warranty or recourse, expressed or implied as to condition, title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto. Alabama law gives some persons and entities that have any interest in the property the right to redeem the property under certain circumstances. Programs may also exist that help persons avoid or delay the foreclosure process. This sale is made for the purpose of paying the indebtedness secured by the mortgage and all expenses incident to this sale, including a reasonable attorney’s fee.
The Mortgagee reserves the right to bid for and purchase this property and to credit its purchase price against the expenses of sale and the indebtedness secured by the mortgage, as provided by the terms of the Mortgage.
